Good TRKR Privacy Policy

Good TRKR has created a digital platform that includes our website(s) and our mobile application(s) and other services (collectively the "Fotition Platform"), which permits users to participate in campaigns conducted by us or our participating charitable organizations and corporate sponsors by among other things, posting photos and videos of themselves in support of the cause(s) or issue(s) represented by the Campaign, which we call "Fotes".

When you visit our website, our mobile application(s), a third-party website using our software and/or platform as a service, or create an account with us or participate in a Campaign or a related promotion, we may collect certain information from you. This Privacy Policy describes the types of information we collect when you visit the Fotition Platform and our practices for using, maintaining, protecting and disclosing that information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Fotition Platform. By accessing or using our website, mobile application or other portions of the Fotition Platform, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see What if There Are Changes to Our Privacy Policy? below). Your continued use of our platform after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

What Information Do We Collect?

We collect several types of information from and about users of the Fotition Platform. This information includes the following:

Information You Provide to Us.

The information we collect on or through the Fotition Platform includes information you provide to us:

• Information you provide when you register for a Fotition account, whether directly with us or via a social network such as Facebook or Twitter. This information includes certain required information such as your name and email address. You will also have the option - but you will not be required - to provide additional information such as your gender, age and zip code. The information we collect when you register through a social network such as Facebook or Twitter will vary based on your privacy settings on those networks.
• Records and copies of your correspondence, including email address, if you contact us.
• Information you provide in carrying out activities through the Fotition Platform, including Fotes and other information that you post in support of a Fotition campaign as well as any information you publish or display in public areas of the Fotition Platform (e.g., message boards and forums) (collectively, "User Contributions").

Please note that your User Contributions are posted via the Fotition Platform and transmitted to or made viewable by others at your own risk. Fotes may be shared by any other user of the Fotition Platform. We cannot control the actions of other users of the Fotition Platform. Please exercise caution when including personally identifiable information in any User Contributions.

Information We Collect Automatically.

As you navigate through and interact with the Fotition Platform, we may use automatic data collection technologies to collect certain information about you and your use of the Fotition Platform, including:

• Details of your visits to the Fotition Platform, including the resources that you access and use via the Fotition Platform.
• Information about your computer and internet connection, including your IP address, operating system and browser type.
• Information about your device type and identifier, if you are participating in a Campaign via our mobile application.

We also may use these technologies to collect information about your Fotes and other content you generate on the Fotition Platform, including the sharing of such content across third-party websites or other online services (behavioral tracking). See below for information on how you can opt out of behavioral tracking and how we respond to web browser signals and other mechanisms that enable consumers to exercise choice about behavioral tracking.

The information we collect automatically is used by us to improve the Fotition Platform and to deliver better and more personalized features to you. For example, we may use this information to:

• Estimate our audience size and usage patterns.
• Store information about your preferences, allowing us to customize the Fotition Platform according to your individual interests.
• Recognize you when you return to the Fotition Platform.

The technologies we use for this automatic data collection may include cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of the Fotition Platform. Children Under the Age of 13.

The Fotition Platform is not intended for children under 13 years of age. No one under age 13 may provide any personal information via the Fotition Platform. If you are under 13, do not register for the Fotition Platform or use any of the interactive or public comment features of the Fotition Platform or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. How Do We Use Your Information?

We use information that we collect about you or that you provide to us, including any personal information:

• To present the Fotition Platform and its contents to you, including to allow you to participate in Campaigns and to provide you with updates regarding Campaigns.
• To invite and allow you to participate in sponsored promotions and sweepstakes and to provide you with updates regarding sponsored promotions and sweepstakes.
• To promote the Fotition Platform, Campaigns and the products and services we offer or provide through the Fotition Platform to you.
• To provide you with information, products or services that you request.
• To fulfill any other purpose for which you provide your information.
• To provide you with notices about your Campaign.
• To carry out our obligations and exercise and enforce our rights arising under the Terms of Service, available at http://www.fotition.com/terms-and-conditions and other agreements, including to exercise the license rights in your Fotes and other user contributions granted to us under the Terms of Service.
• To notify you about changes to the Fotition Platform or any products or services we offer or provide through it.
• To allow you to participate in the interactive features of the Fotition Platform.
• For the purpose of aggregated statistical analysis of how you and others use the Fotition Platform, including the Site and the Application.
• In any other way we may describe when you provide the information.
• For any other purpose with your consent.

We may also use your information to contact you about our own and third parties’ goods and services that we believe may be of interest to you. How Is Your Information Shared?

We may disclose aggregated information about users of the Fotition Platform, and information that does not identify any individual, without restriction. Such information may include statistics regarding participation in specific Campaigns or use of the Fotition Platform generally.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

• To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Good TRKR???s assets, whether as a going concern or as part of a bankruptcy, liquidation or similar proceeding, in which personal information held by Good TRKR about our users is among the assets transferred.
• To our participating charitable organizations and corporate sponsors to enable them to carry out their obligations and exercise and enforce their rights in connection with Campaigns and sponsored promotions and sweepstakes and pursuant to our agreements with them. For example, we may sublicense our right to use your Fotes for promotion of the cause supported by a Campaign to the charitable organization or corporate sponsor sponsoring such Campaign. We contractually require our participating charitable organizations and corporate sponsors to keep personal information confidential and use it only for the purposes for which we disclose it to them. • To fulfill the purpose for which you provide it, including to allow you to participate in Campaigns and sponsored promotions and sweepstakes in accordance with our Terms of Service.
• For any other purpose disclosed by us when you provide the information.

We may also disclose your personal information:

• To comply with any court order, law or legal process, including to respond to any government or regulatory request.
• To carry out our obligations under and exercise and enforce our rights under the Terms of Service and other agreements.
• If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Good TRKR, Fotition, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Other than as described above, we will never provide your information to anyone for any purpose under any circumstances.

If you are a California resident, California law permits you to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to privacy@fotition.com.

What Are Your Choices About How We Use and Share Your Information?

We strive to provide you with choices regarding the information you provide to us. We have created mechanisms to give you the following controls over your information:

Tracking Technologies.

You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our website may be inaccessible or not function properly.

Promotional Offers from Good TRKR.

If you do not wish to have your contact information used by Good TRKR to promote our products or services, you can opt-out by sending us an email stating your request to privacy@fotition.com. If we have sent you a promotional email, the email will have an "unsubscribe" feature that will allow you to opt-out of receiving future email distributions.

Communications through the Platform.

If you did not wish to receive communications through the Fotition Platform from a participating charity or corporate sponsor or another user, we will provide you with a means to block communications from such user through the features and functionality of the Fotition Platform.

How Can You Access and Correct Your Information?

You may send us an e-mail at privacy@fotition.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information that is required for registration except by also deleting your Fotition account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Fotition Platform, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Fotition Platform or persons with whom they have been shared. We may further retain copies of your User Contributions to comply with licenses granted prior to your deletion of such User Contributions as permitted under our Terms of Service, available at http://www.fotition.com/terms-and-conditions. We are not responsible or liable for the removal or deletion of (or failure to remove or delete) any of your User Contributions. Access to and use of information provided via the Fotition Platform, including User Contributions, is governed by our Terms of Service.

How Is Your Information Kept Secure?

We have implemented reasonable measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls and will be backed up on at least a weekly basis.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain aspects of the Fotition Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Fotition Platform, including submissions to Campaigns and postings on message boards or forums. The information you share in public areas may be viewed by any user of the Fotition Platform.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted via the Fotition Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in the Fotition Platform.

What If There Are Changes to Our Privacy Policy?

We will post any changes we make to our Privacy Policy on this page, with a notice that the Privacy Policy has been updated on our website home page. If we make material changes to how we treat your personal information, we will notify you by email to the email address specified in your account, if you have an active one, or by notifying you the next time you log-in to your account.
